New Mexico's PFAS reporting obligation under the PFAS Protection Act (HB 212) went live with rule 20.13.2 NMAC, published May 5, 2026 and effective July 1, 2026. The first reporting deadline is January 1, 2027.
There is no size exemption. The rule covers every manufacturer, brand owner, and importer of products containing intentionally added PFAS that are sold into New Mexico — including online and catalog sellers, not just physical in-state businesses.
Report each product containing intentionally added PFAS through the official New Mexico Product Reporting System (NMPRS). The initial fee is $2,500 with a $1,000 update fee. NMED also publishes free label files for the required container label (see the labeling rule).
Non-compliance can draw penalties up to $15,000 per violation per day.
